Furthermore, you must be a US citizen actually residing in the US, and earning enough to support yourself, all other dependents (e.g. spouse, minor children), plus the son you petition for.

Margy Sandquist: Why do you live outside the USA if you have a Green Card. You're supposed to live INSIDE the USA. You can lose your Green Card privileges if you live outside the USA. And no, you cannot petition for your son if you live OUTSIDE the USA as a Permanent Resident. If you live INSIDE the USA, yes you can, but it will take a while for him to get his papers, and probably if he's 23 years old and not married, he will get married at some point, so .... you better travel back to the USA, wait 5 years, and then become a US Citizen (that is, if they allow you to come back in the USA.)...Show more
