What to do if employment is not reported?

Avis Brantner: Forgot to say she is putting this on a resume. Don't company's do credit checks/background checks to verify employment? Since this job is not on the book and it's on there resume how would you go about explaining that?

Miguel Koczela: It's interesting, but it could be a real problem for both your friend and her former employer. If your friend didn't pay taxes on her earnings, she could have a problem with the IRS. The IRS is usually pretty lenient on people who overstate their deductions, but they can be very tough on those who fail to report their incomes.The employer did not withhold any income taxes for her and obviously didn't withhold and pay F.I.C.A. taxes. When this comes to light, which it probably will, the employer will usually have to pay both ends of F.I.C.A. taxes.Your friend should see an employment lawyer. It will cost some money, but probably not as what it will cost when the IRS catches up with her.This wasn't too bright on her pa! rt. When she goes to interview for a new job, she can't list her former employer on her resume. If she does and a prospective employer contacts her former employer, it can only deny it knows who she is.
